Part A – Using Acard

1. Service

Acard is a free search and referral service for building products and interior materials. It can be used through an open interface (Model Context Protocol, MCP) in AI assistants such as ChatGPT or Claude, and through the website acard.ai. Acard does not sell products and is not a party to any contract between users and manufacturers.

2. Product information

Profiles not marked “verified” are generated automatically from publicly available manufacturer information. They may be incomplete, outdated or incorrect and are not a warranty of any property. For planning, tendering, fire safety, structural design and construction, only the manufacturer’s current original documents are authoritative (declaration of performance, technical datasheet, approval, test certificate). Every value links to its source and must be checked there before use.

3. Ranking

Results are ranked by relevance to the request only. A better position cannot be bought. Verified profiles are labelled as such because their data is confirmed by the manufacturer.

4. Sample and contact requests

Sample and contact requests are forwarded to the manufacturer only after the requesting person has explicitly confirmed them. Whether and when a manufacturer replies or ships a sample is up to the manufacturer. Please provide truthful information only.

5. Acceptable use

In particular, automated bulk extraction of Acard outside the intended interface, circumventing technical limits, sending spam through the request function and any unlawful use are prohibited.

6. Liability

To the extent permitted by law, Acard is liable only for intent and gross negligence; liability for personal injury remains unaffected. Liability for damage resulting from the use of unverified product information without checking the original source is excluded. Mandatory consumer protection provisions remain unaffected.

7. Availability and changes

Acard is under continuous development. There is no entitlement to a specific availability or feature set. Changes to these terms are published on this page.

Part B – Profile terms for manufacturers

8. Scope

Part B applies once a representative of a manufacturer accepts the profile terms in the manufacturer dashboard (“approval”). The accepting person confirms that they are authorised to act for the manufacturer.

9. Licence

The manufacturer grants Acard, free of charge, a non-exclusive, worldwide licence, revocable at any time, to store, process and display its product information, product images, documents (e.g. datasheets, declarations of performance, EPDs) and trademarks and product names for identifying the products – on acard.ai, through the Acard interface in AI assistants (in particular ChatGPT, Claude and other MCP-enabled applications) and in their app or connector directories, including thumbnails, excerpts and translations.

10. Rights to content

The manufacturer warrants that it holds the necessary rights to the approved content, in particular to photographs (including towards photographers or agencies). If any content is challenged, Acard removes it promptly on notice.

11. Requests

Acard forwards sample and contact requests to the address the manufacturer provides. The manufacturer processes the personal data they contain under its own data-protection responsibility and solely to handle the respective request.

12. Data maintenance and labelling

Verified profiles are labelled “verified”. The manufacturer can suggest corrections; Acard reviews them before publication. Acard may continue to use publicly available manufacturer information to keep the profile up to date.

13. Fees

The profile, approval, the “verified” label and the forwarding of requests are free of charge. Additional paid features are provided only under a separate agreement. The ranking of results is independent of any payment.

14. Revocation and removal

The manufacturer can revoke its approval at any time in the dashboard or by email to manufacturers@acard.ai. On request, Acard removes the profile within two business days and stops collecting the manufacturer’s public product data.

Part C – Final provisions

15. Governing law and jurisdiction

Austrian law applies, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. For businesses, the place of jurisdiction is Vienna. Mandatory consumer protection provisions remain unaffected. Should any provision be invalid, the remaining provisions remain in force.
